Panama Formally Revokes CK Hutchison Port Concessions, Clearing Path for Maersk Takeover

Last Monday, the Panamanian government officially published the Supreme Court’s ruling in the Official Gazette, annulling key port operating contracts held by a subsidiary of the CK Hutchison Group. This legal move formally paves the way for APM Terminals - the port-operating arm of the Maersk Group - to begin its temporary takeover.

Ending Over Two Decades of CK Hutchison Operations

The publication of this ruling finalizes the legal cancellation of the concessions for the Balboa and Cristobal terminals, located at either end of the Panama Canal. Previously, Panama Ports Company (PPC), a subsidiary of the Hong Kong-based CK Hutchison, had operated these facilities for more than twenty years.

Immediately after the ruling became legally binding upon its gazetting, the Panama Maritime Authority (AMP) issued a decree to take over both ports to ensure there is no disruption to operations.

Speaking at a press conference, Alberto Aleman Zubieta, head of the technical team overseeing the transition, stated:

“Two separate contracts are being presented to the Board of Directors of the AMP — one for the Port of Balboa and one for the Port of Cristobal — instead of a single contract for both ports.”

At this time, the Maersk Group has yet to issue an official comment on the matter.

APM Terminals’ Temporary Management Roadmap

Earlier in February, Panamanian President Jose Raul Mulino announced that the government would move forward with formalizing an agreement with APM Terminals Panama, a subsidiary of the Danish shipping giant Maersk, to manage and control the ports as soon as the ruling was finalized.

President Mulino emphasized that this arrangement is strictly temporary. While APM Terminals handles day-to-day operations, the state will work on establishing a new long-term concession framework to be put out for tender in the future.

Assessing the immediate legal impact of the event, political analyst Jose Stoute told Reuters:

“The moment the official gazette publishes the court’s ruling Panama Ports loses control of the ports.”

Geopolitical Implications and Global Trade Competition

This ruling, which originated in late January, represents more than a mere shift in economic management; it comes at a time of escalating competition between the United States and China over global trade routes. Observers regard this development as a significant strategic victory for Washington.

U.S. President Donald Trump has consistently advocated for measures to curb Chinese influence over the Panama Canal - one of the world's most vital maritime chokepoints, responsible for approximately 5% of all global maritime trade.
