U.S. Tariff Chaos: What Importers Must Do to Protect Their Interests

The legal battle surrounding U.S. tariff policies has entered an unprecedented phase, plunging importers into a market landscape defined more by volatility than by clear policy. While the Supreme Court recently ruled a large-scale tariff policy unconstitutional, it stopped short of addressing one of the most pressing questions for businesses: Refunds.
The Current Landscape for Importers
As of now, the reality for importers carries very distinct risks:
● Refunds are far from guaranteed.
● Statutory deadlines remain in effect.
● The U.S. administration has signaled its intent to pursue alternative tariff pathways.
By declining to rule on the refund issue and remanding the case to lower courts without specific instructions, the Supreme Court has essentially left the matter open. This ambiguity creates a high level of complexity for importers.
The stakes are considerable because this is the first time a tariff declared unconstitutional has involved such a staggering sum of money. It remains unclear whether the Court of International Trade (CIT) will move to toll statutory deadlines—opening the door for widespread refunds—or limit eligibility to a small subset of companies.
Ben Bidwell, Senior Director for Customs, noted:
“There are still a lot of questions about whether the Court of International Trade will take steps opening the door for widespread refunds, for some companies to get some refunds or whether refunds are even on the table.”
Proactive Action to Preserve Rights
With the legal process still in flux, importers cannot afford to remain passive. Companies must take proactive steps to preserve their legal rights.
“We’re advising our customers what they can do to potentially preserve their rights to at least some refunds and how they should be thinking about their supply chain strategy in light of the tariffs that were struck down,” said Bidwell.
Repositioning Long-term Supply Chain Strategy
A critical point to consider is that the Supreme Court’s ruling is not necessarily a signal of long-term tariff relief. In fact, the administration has already shown it will pursue alternative legal avenues to continue imposing duties, having taken action just hours after the ruling was announced. Consequently, businesses should not rush to overhaul their sourcing or manufacturing strategies based solely on this ruling.
“The most important thing we’re telling our customers is that the Supreme Court ruling doesn’t necessarily change their tariff exposure in the long run or change where they should be buying or manufacturing,” Bidwell noted.
Instead of chasing short-term policy fluctuations, companies should focus on developing a structured sourcing hierarchy. This framework must evaluate the aggregate of several factors: tariff risk, freight costs, geopolitical risk, supply chain design, business continuity, and Total Landed Cost (TLC).
“It’s a much smarter way to ensure your supply chain flexes instead of breaks when any link in the chain changes,” Bidwell concluded.
